These Creator Terms apply in addition to our Terms of Service and Community Guidelines when you publish content or earn money as a creator on OnlyWAM. Your contracting party is Remotion Digital Ltd., Clifton House, Suite 33, Fitzwilliam Street Lower, Dublin, D02 XT91, Ireland.
1. Lite and full
You become a creator by applying in your settings. We review the application and activate you.
- Lite creators only publish images in posts and stories, free for everyone, without 18+ and without paid content. Our team reviews their content before publication by default. Lite creators do not receive payouts.
- Full creators publish images, videos, reels, stories and shop items, including paid content and content marked 18+, and receive payouts.
2. Verification
For full verification you identify yourself with a valid government ID and a selfie holding that ID. With country USA we also need Form W-9. We record the name on your ID as your verified name. We can ask for a new check at any time. No payouts are possible until it is completed.
3. Your content and the people in it
You only publish content that you created yourself or hold all necessary rights to. When you publish, you confirm that every person shown was at least 18 years old when it was recorded and agreed to it, and that you keep proof of age and consent. We can ask for this proof at any time. If you do not provide it, we remove the content.
You mark adult content as 18+. Our team reviews it before it appears.
4. Rights in your content
Your content stays yours. You allow us, free of charge, to store it, process it technically (for example for thumbnails) and show it on OnlyWAM to the users you make it available to.
You also allow us to use your public content and your profile free of charge to promote you and OnlyWAM, on OnlyWAM, in our social media channels and in ads. We do not use subscriber-only content, pay-per-view, anything marked 18+ or content showing other people for this.
If you delete content or your account, these rights end. We may keep showing content to buyers who have already bought it. We no longer use the content for new promotion and end running promotion within 30 days.
5. Prices and platform fee
You set your own prices. We can set minimum and maximum prices. We keep a platform fee from every sale. We set the amount and show it in your account. We can agree a different fee with individual creators. We pay commissions for referred users out of our platform fee.
6. Ranking in Explore and "For you"
We rank posts and creators mainly by
- how new a post is and when the creator last published something (this counts most),
- how many active posts and likes the creator has,
- how users react to a post, measured against how often it was shown,
- for signed-in users, their interests, subscriptions and likes, unless they have switched this off.
We regularly reshuffle entries with similar scores. Sponsored places are labelled "Sponsored" and do not change the rest of the order. A better position outside these places cannot be bought.
7. Balance and payouts
We credit your share of every sale to your balance. We credit your share of a physical item once the buyer confirms receipt, at the latest 14 days after shipping, or 21 days for shipping abroad. If the buyer reports a problem before then, we credit it once the problem is resolved. If you do not ship within 5 days of the purchase, we cancel the order and refund the buyer.
- Your payout account must be in your verified name. If it is in another name, we need proof and check it before the first payout.
- We set a minimum amount, a maximum amount and a reserve that stays in your balance, and show them to you before every request.
- You can only have one payout open at a time. We deduct the requested amount from your balance straight away.
- If we refuse a payout, we credit the amount back and tell you why.
8. Refunds to buyers
You can refund purchases yourself, and we can refund too, for example after a cancellation. We deduct your share of that sale from your balance. If you do not deliver Custom Content by the agreed deadline, we automatically refund the full amount to the buyer and deduct your share from your balance. If your balance is too low, we do so as soon as it is enough.
9. Self-billing
For every payout we issue a payout statement in your name and on your behalf (self-billing). Before you add a payout account, you accept the self-billing agreement in your account. If we change it materially, we present it to you again.
- The statement is issued in the name of your payout account and shows the gross amount, the platform fee and your net share. You find it in your account.
- You do not issue us a separate invoice for the same earnings.
- You check every statement and object within 30 days if something is wrong. After that it counts as accepted.
- You tell us without delay if your name, address, bank details or tax status change, in particular if you become liable for VAT.
- The agreement applies until you or we end it. After that you invoice us for your earnings yourself.
If this summary differs from the agreement, the agreement applies.
10. Taxes
Remotion Digital Ltd. is not registered for VAT. The statements therefore show no VAT. You are self-employed and solely responsible for declaring and paying tax on your earnings in your country of residence, meaning income tax and, where applicable, VAT and social security contributions. No employment relationship arises. We do not give tax advice.
11. Data
In your account you see your sales, earnings, payouts and figures for your content. If you sell physical items, you receive the buyer's delivery address. You only use it for shipping and are responsible for it under data protection law yourself.
We have access to all data you and your buyers provide or generate on OnlyWAM and use it as described in our Privacy Policy. You do not receive aggregated data about other creators. We only share data with third parties as described there. After your creator account ends, you can view your payout statements in your account until the last payment and request them from us afterwards.
12. Changes
If we change these terms or the platform fee, we email you the change at least 15 days in advance. If you do not agree, you can terminate before then.
13. Restriction, suspension and termination
We can restrict, suspend or end your creator account if
- you breach these terms, the Terms of Service, the Community Guidelines or the law,
- your verification details are false or you do not complete a check we asked for,
- there are concrete signs of fraud or money laundering,
- an authority or court requires it.
At the latest when a restriction takes effect, we email you the reasons. If we want to close your account for good, we send you the reasons at least 30 days in advance, unless a law requires us to act faster, there is a compelling reason or you have breached the rules repeatedly. You can respond through the contact form.
You can end your creator account at any time by deleting your account in your settings. You must complete open orders and payouts first.
If your creator account ends, we pay out your balance, including the reserve, in monthly payments of up to €500 to your payout account until nothing is left. The first payment follows 30 days after the end. There is no maximum duration. If your balance is below the minimum payout amount, we pay it in full with the first payment. The end is the day you request deletion or we close your account. Until everything is paid out, your account stays hidden; after that we delete it for good. We may only deduct refunds to buyers, chargebacks and proven damage. In case of fraud we only keep as much as we have to refund to buyers or pay as damages.
